APPLICABILITY OF DISCLOSURE LAW

QUESTION:
Am I, as acting City Clerk of Plant City, a public officer within the meaning of that term as found in part III, Ch. 112, F. S. (1974 Supp.), and therefore subject to the disclosure law as it applies to public officers?
Your question is answered in the negative.
Enclosed please find a copy of a previous opinion of this commission, CEO 74-17, the rationale of which is equally applicable to your question. Please note, however, that although you are not a "public officer" by virtue of your position as acting city clerk, you may fall within this category if you have "the power normally conferred to purchasing agents by whatever title." See s. 112.312(7)(j), F. S.
